By accessing, subscribing, or using Altimate Pilot services, you are accepting this Agreement. You should read these Terms of Use carefully before using our services. If you do not agree with these Terms of Use, please refrain from using Altimate Pilot services and websites.

We reserve the right to change our Terms of Use at any time and for any reason. Such changes will take effect on the posted date (i.e., the "Last Update Date" of these Terms of Use).

    1. Service Provider

The "Altimate Pilot" application (the "App"), available at the Apple App Store and the Google Play Store App, is owned and operated by Altimate Pilot (Julian Lazar, Schötmarsche Str. 55a, 33818 Leopoldshoehe, Germany)

1.1. Altimate Pilot services are provided for individual users (pilots). Unless otherwise agreed in a separate written contract, these Terms of Use apply equally to both types of services.

    2. Your Consent to the Service

2.1. You must be over 16 or the age of majority in your province, territory, or country to use the Altimate Pilot service.

2.2. You agree to use the Altimate Pilot service, including all features and functionalities associated, in compliance with all applicable laws, rules, and regulations, as well as any other restrictions on the use of the service or content therein.

2.3. You also agree not to decompile, reverse engineer, or disassemble any software or other products or processes accessible through the Altimate Pilot service; nor insert any code to manipulate the Altimate Pilot service destructively.

2.4. In addition, you agree not to upload, post, email, or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment associated with the Altimate Pilot service, including any software viruses or any other computer code, files, or programs.

2.5. The Altimate Pilot software is developed by, or for, Julian Lazar and is designed to enable the management, storage, and viewing of data through web-browser-enabled devices and mobile devices running iOS and Android operating systems. The Altimate Pilot software may vary by device and medium, and functionalities and features may differ between devices. You acknowledge that the use of the service may require third-party software that is subject to third-party licences. You agree that you may automatically receive updated versions of the Altimate Pilot application, user interface, and related third-party software.

    3. Subscription, Payments & Billing

3.1. Free Trial Period of Ultimate Pilot Pro

3.1.1. Your subscription starts with a free trial. The free trial period can vary. The free trial period is limited and is intended to allow new users and certain former users to try the service.

3.1.2. Altimate Pilot Pro determines free trial eligibility at its sole discretion, and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold if we determine you are not eligible.

3.1.3. We may use information such as device ID, payment method or an account email address used with an existing or recent subscription to determine eligibility. For combinations with other offers, restrictions may apply.

3.2. Activation of Altimate Pilot Pro Subscription

3.2.1. In-app subscriptions (Apple App Store or Google Play) provide full access to both the mobile app and the web app when signed in with the same credentials used for the initial purchase.

3.2.2. Your Altimate Pilot Pro subscription will continue month-to-month (or year-to-year) until terminated.

3.2.3. All subscriptions are non-refundable, and no credits are provided for unused periods, accidental purchases, or any other reasons, unless required by law.

3.2.4. To use the service, you must have Internet access and a compatible device and provide a current, valid, accepted method of payment, which you may update from time to time ("Payment Method"). Unless you cancel your subscription before your billing date, you authorise us to charge your next subscription fee to your Payment Method (see "Cancellation" below).

3.2.5. If payment is not successfully settled, we will immediately suspend your access to the service until the subscription is renewed. This usually happens for several reasons: your card has expired, lack of funds or funds on hold, or your bank declined the transaction for a reason unknown to us. In this case, please check your account profile and renew your subscription.

3.2.5. Altimate Pilot cannot manage or modify in-app subscriptions purchased through the Apple App Store or Google Play. If you wish to cancel your subscription, you must do so directly through the Apple App Store or Google Play.

3.2.6. For more information, see Section 3.5 ("Cancellation of the Subscription").

3.2.7. We ensure secure card payments through trusted transactional payment provider RevenueCat.

    3.3. Billing Cycle

3.3.1. The subscription fee will be charged on a monthly or yearly basis to your Payment Method on the calendar day corresponding to the commencement of your paid subscription.

3.3.2. In some cases, your payment date may change, for example, if your Payment Method has not settled successfully or if your subscription began on a day not contained in a given month or year. Visit your Account profile to see your next payment date.

3.4. Cancellation of Altimate Pilot Pro Subscription

3.4.1. You can cancel your subscription at any time. You will continue to have access to the Altimate Pilot Pro service through the end of your current billing period. After this period, your account will be suspended.

3.4.2. If you subscribed through a third party (Apple App Store, Google Play Store) and wish to cancel your subscription, you must do so directly through that third party.

3.4.3. We are not obligated to provide any services or support to users without an active subscription. We strongly recommend that you download your data before cancellation. We reserve the right to charge a fee for data recovery if your account is suspended due to non-payment or if a payment dispute is raised with your bank.

    4. Changes to Price and Service Plans

We may occasionally update our service plans and pricing. We will notify you of changes at least 14 days before they take effect. These notifications will be sent electronically to the email address you provided.

    5. Account Access & Passwords

5.1. The user who created the Altimate Pilot account and whose Payment Method is charged (the "Account Owner") has access and control over the Altimate Pilot account. To maintain control over the account and prevent anyone from accessing the account, the Account Owner should maintain control over the devices used to access the service and not reveal the password nor details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold to protect you, Altimate Pilot, and our partners from identity theft or other fraudulent activity.

5.2. Accounts created but never activated, or without an active subscription within 12 months of creation, will be permanently deleted in line with our inactive account policy.

    6. Data Ownership & Copyright

6.1. You are solely responsible for legality of data uploaded to the Altimate Pilot service by you or your automated device (smartphone, personal computer, etc.).

6.2. By using our service, you consent that anonymized or aggregated data may be used by Altimate Pilot for statistical analysis, service improvements, and limited marketing purposes (such as general usage trends). Altimate Pilot will not provide personal data to any third party for commercial or non-commercial purposes without your explicit consent.

6.3. For Business accounts, the organization remains the controller of all uploaded operational and customer data. Altimate Pilot acts solely as a processor providing hosting and technical services, unless otherwise agreed in a separate Data Processing Agreement (DPA).

    7. Customer Support

7.1. Our typical response time is 24 - 48 hours. In the case of high-volume requests, priority is given to Premium plan subscribers and Business customers. Support is guaranteed only to customers with an active subscription.

7.2. To contact our customer service, please use the email address info@altimatepilot.app. No other contact methods are available for now.

    8. Miscellaneous

8.1. Data Loss and Backup We assume no liability or responsibility for any errors, omissions, mistakes, inaccuracies, or loss of data in the Altimate Pilot application or stored user data. As a user of the Altimate Pilot services (for pilots or organizations), it is your sole responsibility to back up your user data (flight logs, personal notes, certificates, attachments, customer data, etc.) and to keep these records separate from the Altimate Pilot app (e.g., in a CSV file, PDF, printed copy, paper logbook, spreadsheet). Altimate Pilot do not replace your responsibility to maintain independent backups of your data.

8.2. User's Responsibility for Backups We strongly recommend that all users back up their data regularly. You can easily do this with iCloud, Google Drive, or your local drive. Backup files are generated in standard formats and can be opened in any spreadsheet editor, such as Apple Numbers, Google Sheets or Microsoft Excel. To access the backup feature, go to your user profile and scroll down to Backup.

8.3. Use at Your Own Risk You use the information and features in Altimate Pilot at your own risk. Liability is governed by section 9.

8.4. Governing laws These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any litigation will be judged by a court in Germany under the laws of the Federal Republic of Germany.

8.5. Survival If any provision or provisions of these Terms of Use are held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

8.6. Electronic Communications We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

8.7. Data Import Services Altimate Pilot is not obligated to import files or data on behalf of users. Each user is responsible for preparing and uploading their own logbook data in the supported formats. In certain cases, Altimate Pilot may assist with data imports; however, this service is optional, not guaranteed, and in the case of complex or legacy data, subject to an additional fee.

    9. Disclaimer & Third-Party Data

9.1. Not a Sole Basis for Decisions Altimate Pilot supports flight preparation but does not replace official flight preparation. Weather data, METAR/TAF, NOTAMs, airspace and airfield information, the Flyability Score, route, time and fuel calculations, and AI Copilot (Beta) answers are for reference only. They must not be used as the sole basis for flight decisions.

9.2. Pilot Responsibility The pilot in command (PIC) remains solely responsible for flight preparation, the go / no-go decision and the safe conduct of the flight. This includes consulting official sources (e.g. official aviation weather, AIP, NOTAM briefing) and complying with all applicable aviation regulations.

9.3. Third-Party Data Some of the information shown comes from external providers, such as weather services, aviation data sources, map and radar providers, and webcam operators. We have no control over their content and give no guarantee for its accuracy, completeness, timeliness or availability. Data may be delayed, incomplete, incorrect or temporarily unavailable. Third-party content is also subject to the providers' own terms.

9.4. AI-Generated Content AI Copilot answers are generated automatically and may be incorrect, incomplete or outdated. They do not replace an official briefing or professional advice.

9.5. Limitation of Liability We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
